INTERDIVISIONAL SERVICE: LAS VEGAS/WEST COLTON

In connection with Union Pacific’s Notice dated October 16, 2008, of its intent to establish new interdivisional unassigned (pool) through freight service between Las Vegas, Nevada, and West Colton, California, pursuant to Article IX, “Interdivisional Service”, of the 1985 National Agreement, the parties agree the following shall apply to this new service:
Section 1. Terminals for Run. Las Vegas, Nevada, shall be the Home Terminal for trainmen working in the new interdivisional service between Las Vegas and West Colton created by this Agreement. West Colton shall be the away-from-home terminal for these trainmen.
Section 2. Miles of Run. Crews working in this interdivisional service will be allowed 278 miles, subject to final verification of the actual mileage.
Section 3. Employee Protection. Trainmen adversely affected by the initial implementation of this interdivisional service will be afforded the protection benefits provided in Section 7 of Article IX of the October 31, 1985 UTU National Agreement.
Section 4. Rate of Pay. The trip rate for this new interdivisional service will be $364.17 and shall be subject to future general wage increases and cost of living allowances.
Section 5. Rules and Working Conditions.
(A) Except as specifically set forth herein, applicable provisions of the Agreement between the Union Pacific Railroad and the United Transportation Union covering the Eastern District and applicable provisions of National UTU Agreements, shall apply.
(B) The provisions of Paragraph 5 “Overtime” of Attachment “A” to the Merger Supplemental Agreement (Salt Lake City) between the Union Pacific Railroad and the United Transportation Union dated September 18, 1997 and effective October 1, 1997, shall apply.
Section 6. Transportation. Transportation will be provided in accordance with Section (2) (c) of Article IX of the October 31, 1985 UTU National Agreement.
Section 7. Suitable Lodging. Suitable lodging will be provided by the Carrier in accordance with Section 1 of Article II of the June 25, 1964 UTU National Agreement.
Section 8. Hours-of-Service Relief.
Turnaround service/hours of service relief at both home and away from home terminals shall be handled by extra boards, if available, prior to setting up other trainmen. Trainmen used for this service may be used for multiple trips in one tour of duty in accordance with the designated collective bargaining agreement rules. Nothing in this section prevents the use of other trainmen to perform work currently permitted by prevailing agreements.
Section 9. Access of Los Angeles Hub Trainmen to Turns in this New Interdivisional Service
A) Only trainmen working in the Los Angeles Hub who hold a seniority date prior to the effective date of this Agreement will be afforded access to designated “WC” turns in this new interdivisional service.
B) On the effective date of this Agreement, the Carrier will post a bulletin for this new interdivisional service. This bulletin will be open to all trainmen holding seniority in the Salt Lake Hub and all trainmen holding seniority in the Los Angeles Hub who have a standing application on file with CMS.
C) The first (2) turns in this pool will be split 50/50 between applicants from the Salt Lake and Los Angeles Hubs. Thereafter, assignments to the necessary turns in this pool will be made on the basis of one (1) turn to the senior trainman covered by paragraph A (of this section) for every two (2) turns awarded to trainmen holding seniority in the Salt Lake Hub.
Example: Turn 1 will be awarded to the senior bidder holding seniority in the Salt Lake Hub and Turn 2 awarded to the senior bidder from the Los Angeles Hub with standing application on file. Thereafter, Turns 3 and 4 will be awarded to the senior applicants holding seniority in the Salt Lake Hub and Turn 5 awarded to the senior applicant holding seniority in the Los Angeles Hub and so on and so forth. See Exhibit “A”.
D) Trainmen in the Los Angeles Hub who are assigned to turns in this new interdivisional service will be governed by the rules and Agreements applicable to the Salt Lake Hub Agreement while so assigned, but will not have rights to any other work in the Salt Lake Hub and will not establish seniority in the Salt Lake Hub.
E) In the event no bids are received for the turns designated as “WC” in this new interdivisional service (on Exhibit “A”), the “WC” turns will be assigned to trainmen holding seniority in the Salt Lake Hub.
F) In the event is it necessary to reduce the number of turns in this service, said reductions will be made in reverse seniority order on the basis of the designation of the last turn assigned. Los Angeles Hub trainmen reduced from the pool or making displacement into the pool may only displace to a designated “WC” turn. However, in the event there are no junior Los Angeles Hub trainmen in the pool to displace, such trainmen may displace the junior Salt Lake Hub trainman holding a designated “WC” turn in the pool.
Section 10. Effective Date. The Carrier shall give the General Chairmen forty-five (45) days’ written notice of its desire to implement this operation. During this forty-five (45) day period, assignments to this new interdivisional service will be bulletined and awarded to qualified applicants and training will be conducted in accordance with Side Letter 1.
